快遞暫行條例征求意見(jiàn)：泄露用戶信息或被吊銷經(jīng)營(yíng)許證

7月24日，國(guó)務(wù)院法制辦公室官網(wǎng)發(fā)出《快遞暫行條例》（征求意見(jiàn)稿）。《征求意見(jiàn)稿》中規(guī)定，地方各級(jí)人民政府應(yīng)當(dāng)確保政府相關(guān)行為符合公平競(jìng)爭(zhēng)要求和相關(guān)法律法規(guī)，維護(hù)快遞業(yè)競(jìng)爭(zhēng)秩序，不得出臺(tái)違反公平競(jìng)爭(zhēng)，可能造成地區(qū)封鎖和行業(yè)壟斷的政策措施。

征求意見(jiàn)稿第十二條規(guī)定，縣級(jí)以上地方人民政府公安、交通運(yùn)輸?shù)炔块T(mén)和郵政管理部門(mén)應(yīng)當(dāng)加強(qiáng)協(xié)調(diào)配合，建立健全快遞運(yùn)輸保障機(jī)制，依法保障快遞服務(wù)車輛通行和臨時(shí)停靠的權(quán)利，不得禁止快遞服務(wù)車輛依法通行。

同時(shí)，征求意見(jiàn)稿規(guī)定，經(jīng)營(yíng)快遞業(yè)務(wù)的企業(yè)停止經(jīng)營(yíng)的，應(yīng)當(dāng)提前10日向社會(huì)公告，書(shū)面告知郵政管理部門(mén)，交回快遞業(yè)務(wù)經(jīng)營(yíng)許可證，并依法妥善處理尚未投遞的快件。

此外，意見(jiàn)稿第四十二條還提及，若經(jīng)營(yíng)快遞業(yè)務(wù)的企業(yè)有違反條令行為之一的，由郵政管理部門(mén)責(zé)令改正，沒(méi)收違法所得，并處1萬(wàn)元以上5萬(wàn)元以下的罰款；情節(jié)嚴(yán)重的，并處5萬(wàn)元以上10萬(wàn)元以下的罰款，并可以責(zé)令停業(yè)整頓直至吊銷其快遞業(yè)務(wù)經(jīng)營(yíng)許可證。
